Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the Dialvia Limited services (“Service”), including our website, mobile applications, and related APIs. By registering for or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. Definitions
- User: Any individual or entity who registers for or uses the Service.
- Credits: Units of value purchased by Users to place calls.
- Auto Top-Up: Optional feature that automatically replenishes Credits when a User’s balance falls below zero.
3. Eligibility & Account Registration
- You must be at least the minimum age required by your local jurisdiction to use the Service.
- You agree to provide accurate, current, and complete information during registration and to keep it updated.
- Each account is non-transferable and for your personal or business use only.
4. Credits & Billing
- All calls consume Credits based on duration, rounded up to the next full minute.
- Credit rates vary by destination and are published on our site.
- Payments are processed by Stripe; we do not store raw payment information.
5. Auto Top-Up
- Optional Feature: Users may enable Auto Top-Up on the Buy Credits page.
- Trigger: When a call leaves your balance below zero, Auto Top-Up charges your saved card off-session.
- Minimum Charge: $5 per top-up. You are only charged the amount you went negative, subject to the $5 minimum.
- How to Enable: Check “Enable auto top-up” and complete any purchase to save your payment method.
- How to Disable: Uncheck the box on the Buy Credits page—no further purchase required.
- Records: All top-up transactions appear in your Billing History with date, amount, and credits added.
6. Analytics & Data Collection
- Analytics Services: We use PostHog analytics to understand how users interact with our Service and to improve functionality.
- Consent-Based Tracking: Analytics data collection requires your explicit consent through our cookie banner.
- Data Usage: Analytics data helps us identify usage patterns, technical issues, and opportunities for service enhancement.
- Opt-Out: You may decline analytics at any time without affecting your ability to use core Service features.
- Privacy Compliance: Our analytics practices comply with applicable privacy laws and regulations.
7. Refunds & Cancellations
All credit purchases are final after 7 days from account creation. To request a refund for errors or disputes, contact us at [email protected]. Refunds, if granted, may be subject to verification.
Referral Program Exception: Users who sign up through a referral link are not eligible for the 7-day money-back guarantee. This exclusion is necessary to prevent abuse of our referral reward system where referrers earn discount codes when referred users make purchases.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIALVIA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO INTERRUPTED CALLS, DATA LOSS, OR THIRD-PARTY ACTIONS.
9. Indemnification
You agree to indemnify, defend, and hold harmless Dialvia and its officers, directors, employees, and agents from any claims, liabilities, or expenses arising from your breach of these Terms or your use of the Service.
10. Modifications & Termination
We may modify or discontinue the Service, in whole or in part, at any time with or without notice. We may terminate or suspend your access if you violate these Terms or for any lawful reason.
11. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in London, UK.
